yackfou.com performs all deliveries and achievements towards her contracting partners (in the following customer) exclusively on basis of these terms and conditiones.

A contract comes about only by order of the customer by means of (Online-)order form and his acceptance by yackfou.com. Yackfou.com accepts the order after dispatch of the order or by delivery of the ordered product. The order is limited to budgetary-usual amounts (not industrial amounts).

Our offers are subject to change, this means that we are not obliged to the achievement in case of the unavailability. We reserve ourselves to produce an achievement, which is equivalent in price and quality.

With all our products you have a right of return of 14 days. The period shall begin no sooner than one day after with preservation of the product and the receipt of this instruction. Provided that you cancelled the contract within 14 days under the terms of the contract of 3.1, after the product has come with the designated receiver, and the order value amounts to more than 40 EUR (without delivery expenses), we refund for you the costs of the return by credit of the suitable amount on your account. With an order value (without delivery expenses) to 40 EUR, You have to bear the regular back end costs, unless the delivered product is not equal to the order product.

5.3a for end customers
Accounting takes place against prepayment or by cash on delivery.

5.3b for resellers
All prices are given in EURO and are cacculated inclusive of VAT and plus the costs for the dispatch.

5.2
The value added tax amounts to 19% within Germany. All offers and prices are without obligation and are subject to change. Changes and mistakes are subjects to change.

5.3a for end customers
Accounting takes place against prepayment or by cash on delivery.

5.3b for resellers
Accounting takes place with the first orders by prepayment or cash on delivery. Afterwards by calculation.

5.4
Single discount actions and special actions are explicitly expelled with the articles and are limited in the offer length.

6.1 for resellers
the customer is in delay 30 days after calculation preservation. The first reminder costs 2 euros plus interests on arrears by height 9.26% (adapted from the base lending rate of the German Central Bank as at May 2007). Then the second reminder occurs 30 days on receipt of the first reminder and is the last request for payment with a dunning charge of other 5 Eur plus interests on arrears.

The product remains our property up to entire payment, even if the product is resold (extended retention of title). With default we are entitled to withdraw from the contract and to claim back the purchase thing.

In case that a supplier of us in spite of contractual obligation does not deliver the ordered product any more and this leads to an achievement obstacle blameless from us we are entitled to the resignation. In case of the resignation we will inform you immediately about the non-availability and refund already produced considerations immediately.

The compensation is only allowed if your demand is ascertained indisputable or legally.

A retention right exists only if your counterclaim is based on the same contractual relationship.

We take over no liability for damages which have originated from an improper use with our products.

If the delivered goods fall short at the time of the danger crossing, we will provide for the removal of the lack or spare delivery. While missing the finishing touches or spare delivery, you can require the lowering of the reimbursement or after your choice rescission of the contract.

9.3
Our liability for own fault as well as that of our legal representatives and fulfilment assistant limits itself to intention and gross carelessness.

The data necessary for for business purposes are stored under strict attention of the regulations of the Federal Data Protection Act / BDSG and of the information and communication services law / IuKDG and are transmitted by the order handling if necessary to affiliated companies as well as third companies, which are employed for the order order handling (for example, German post). All personal data are treated strictly confidentially.

The general terms and conditions and the whole legal respect between the customer and Yackfou shall be governed by the laws of the Federal Republic of Germany. Place of venue shall be the competent county court of Berlin.

Changes or additions to this contract - especially to this written form requirement - are valid only in written form.

12.2
All explanations can be directed on electronic way to the customer. This is also valid to accounts within the contractual relationship.

12.3
Are or become single regulations of these general terms and conditions ineffective, the effectiveness of the other regulations is not thereby touched. To the place of the ineffective regulation answers the regulation, which is approaching to the economical purpose of the arrangement.
